Stimmt’s general terms and conditions are written heavily in their favor and place significant restrictions on you as the client. You can’t suspend or set off payments—even if you’re unhappy with the progress or the quality of the work. It’s also practically impossible to end the collaboration early without their consent, so you’re locked into their terms. Stimmt only provides an “efforts obligation,” not a result guarantee. That means they don’t have to prove that your goals were achieved, but you are still required to pay according to the agreed schedule. In addition, unforeseen extra work costs can be passed on to you, leaving you with little control over the total project cost. As for complaints, the process is minimal. Even though, for example, a Notice-and-Takedown procedure is included, in practice Stimmt often remains the deciding party in disputes. That means you’re dependent on their interpretation and decision-making, which creates a risk if issues arise with the quality or delivery of their services. Another risk is that Stimmt can terminate the collaboration if you don’t pay on time—regardless of the reason. In that case, their services may be suspended or ended, and you’ll lose access to what has already been developed or delivered. This could mean you get nothing at all, even if you’ve already paid in part or in full. For example, if a dispute arises over an invoice, it could lead to losing access to your website or software. I strongly recommend reviewing the terms carefully and making clear arrangements in advance about liability, guarantees, complaint handling, and costs, so you don’t get any unpleasant surprises. For instance, discuss how complaints are resolved, how additional work costs are billed, and how situations involving suspension or termination are handled.
